Website Contract Terms & Conditions

Copyrights and Trademarks: The client agrees that any content given to Switch It Up Designs including elements of text, graphics, photos, designs, trademarks, or any other artwork for inclusion in their web pages is either owned by the client or the client has permission from the rightful owner to use these elements and will protect, defend, and hold Switch It Up Designs and it’s subcontractors harmless from any claim or suit arising from the use of such content.

Age: Client certifies that he or she is at least 18 years of age.

Content: Switch It Up Designs will not design or host any website containing adult content or pornography.

Content: Switch It Up Designs represents that the portfolio contained on its website is an accurate depiction and illustration of the professional, high quality work that it produces, and that the client has relied upon said portfolio in selecting Switch It Up Designs as its contractor and entering into this agreement.

Authorship Credit: The client agrees that Switch It Up Designs may put a hyperlink on the bottom pages of their website establishing authorship and credit. Client also agrees that Switch It Up Designs may advertise the client’s website as an example of their work.

Additional Expenses: Client agrees to reimburse Switch It Up Designs for any additional expenses necessary for the completion of the work. Examples of this would be (but not limited to) purchase of special fonts, graphics, stock photography, templates, themes, software, scripts, etc. The client will always be informed of additional charges prior to being billed for them.

Additional Services: Any extensive additions or full redesign the client wishes Switch It Up Designs to perform, not already specified in this contract, shall be considered “additional” and will require a separate payment and signed agreement.

Maintenance and Hourly Rate: All website maintenance and software updates are included free of charge with all Monthly Loyalty Plans. Any additions and changes to the site will be billed at an hourly rate of $75.00.

Payment Information

Payments to Switch It Up Designs are due and payable on the following schedule:

Monthly Website Loyalty Program
Initial payment is due at the signing of your website design contract. Future payments are due in a recurring, scheduled manner as stated in your contract. Payments will hold true to that day for the entire agreement period.

Delinquent bills will be assessed a $20.00 charge if payment is not received within 5 business days of the due date. Switch It Up Designs reserves the right to remove web pages from viewing on the internet until payment is made. In the case that collection proves necessary, the client agrees to pay all fees incurred by that process. Regardless of the place of signing of this agreement, the client agrees that for purposes of venue, this contract was entered into Lancaster, PA, and any dispute will be litigated, or arbitrated in Lancaster County, PA.

Standard Website Agreement
Half of total design fee is due at the signing of your website design contract. Second half to be paid in full before the website goes live or is transferred to client’s server.

Any Deposits and or other monies paid shall be non-refundable, except as otherwise stated in your agreement.

Cancellations

All Monthly Loyalty Programs ($99/month) are for a 48 month period. Should you stop payment during your agreement period, you will be billed the remaining amount of your agreement and your website will be removed from the server until agreement is paid in full.

You do not own the rights to your website until the entire balance is paid in full. Once your initial 2 year agreement is completed you then have the option of buying out your website for full ownership, or continuing a monthly payment plan until your website is paid in full. Until your website is paid in full, you are not the rightful owner of the content.

Switch It Up Designs does not under any circumstance issue refunds once a payment has been received. We invest a great deal of financial resources, talent & fees paid to subcontractors and vendors for your site, from the moment you pay us your design deposit or first months set-up and payment.
